Immigration Status and Child Custody in Illinois

An immigration concern does not answer who should make a child’s major decisions or how parenting time should work. Illinois uses the child’s best interests and limits when immigration-status evidence may be introduced in civil court. A useful plan addresses the actual parenting issue, any immediate care needs and the separate immigration case.

Can an undocumented parent seek custody in Illinois?

Illinois parenting cases separate significant decision-making from parenting time. Under 750 ILCS 5/602.5 and 602.7, both questions turn on the child’s best interests. The statutes direct the court to consider matters such as the child’s needs, care history, relationships, adjustment to home and school, and the parents’ ability to cooperate. Conduct that does not affect a parent’s relationship with the child is excluded from those allocation decisions.

These are child-focused standards. An immigration label should not substitute for evidence about daily care, safety and the proposed arrangement. A noncitizen parent can seek parenting time and decision-making responsibilities, but no immigration category guarantees a particular result. The details of the parenting case and any practical effect on the child still matter.

For the underlying family-court process, see our Chicago child custody representation page. Immigration relief, work authorization and permission to travel require a separate assessment.

Can the other parent use immigration status in court?

735 ILCS 5/8-2901 generally makes evidence of a person’s immigration status inadmissible in Illinois civil proceedings, subject to stated exceptions. Those exceptions include evidence essential to an element of a claim or affirmative defense, certain evidence of witness interest or bias, and voluntary disclosure to the court by the person or their attorney.

The statute also sets a procedure for a party seeking to offer that evidence: a written motion ordinarily at least 14 days before the hearing or trial, notice to the parties, and a private court review with counsel present. The judge may change the filing time for good cause. The motion, related papers and hearing record are sealed unless the court orders otherwise.

This is more precise than saying immigration status can never be mentioned. Discuss a proposed disclosure or objection with counsel before putting immigration documents into a public filing. Preserve messages containing threats and ask your lawyer how to address them. The statute separately prohibits threats or disclosures intended to deter truthful testimony.

What if a parent is detained or cannot provide daily care?

Start with the child’s immediate needs: where the child is staying, who can collect them from school, access to medication, and the next exchange under the existing order. Give your family lawyer the actual detention or hearing information you have, instead of relying on predictions from the other parent.

Existing parenting orders, temporary relief and any proposed guardian or caregiver arrangement need to be reviewed together. A handwritten care plan does not automatically change a court order, grant every form of decision-making authority or end the other parent’s rights. Identify the document and court process that fits the situation.

Where a child faces a present safety concern, ask promptly about emergency parenting relief. A custody order addresses the family-law issues before that court; it does not resolve a federal immigration case. Coordinate counsel if proceedings in both systems are active.

How should travel and relocation be handled?

Moving the child, an extended stay abroad and a parent’s inability to return are different issues. Before making travel arrangements, review the parenting judgment, passport provisions, travel notice requirements and whether a proposed move is a legal relocation. Do not assume that permission for a vacation also permits a permanent move.

Bring the proposed destination, dates, school plan and travel documents to the consultation. Our Illinois child relocation lawyers page explains the service for proposed moves. Immigration counsel should separately assess travel and reentry consequences for the particular person; this guide does not predict those consequences.

What should immigrant parents bring to a custody consultation?

  • The parenting judgment, support orders, pending motions, case number and next court date.
  • A short account of the child’s current routine, school, health needs and each parent’s care responsibilities.
  • Relevant communications, including any threats about immigration status, kept in their original context.
  • Known dates or documents from an immigration proceeding, shared privately with counsel when relevant.
  • A practical proposal for transportation, temporary care and communication with the child.

Ask who will handle the family case, whether separate immigration counsel is needed, how urgent filings will be addressed, and what representation covers. Share sensitive records through the method the firm provides after intake rather than publishing them in a review or open comment.

Questions to discuss with counsel

Frequently asked questions

Answers to help identify the issue and prepare for the next step.

Does being undocumented automatically prevent parenting time in Illinois?

No immigration label by itself answers the best-interest inquiry under Illinois parenting law. Courts consider the child’s needs and the evidence relevant to parenting. Illinois also limits the admission of immigration-status evidence in civil proceedings under 735 ILCS 5/8-2901.

Can the other parent disclose my immigration status to gain an advantage?

Illinois generally excludes immigration-status evidence in civil cases, with specific statutory exceptions and a court-review procedure. Preserve the actual communication and discuss admissibility, confidentiality and any threat with your lawyer before responding or filing sensitive documents.

Does a family-court parenting order protect a parent from removal?

A parenting order does not decide a federal immigration case. Family and immigration counsel may need to coordinate the care plan, court appearances and any travel concerns. Do not assume that one proceeding automatically controls the other.

What should I do if detention disrupts a parenting schedule?

Give counsel the existing order, the child’s current care arrangements and the known dates. Ask whether temporary court relief or another care document is needed. Avoid assuming that an informal agreement alone changes an existing parenting order.
