What affects the cost of divorce in Illinois?
The useful starting point is the work your case requires, not a statewide average. Agreement on some issues can narrow that work. Disputes, missing information and repeated proceedings can add preparation. The effect on your payments depends on the written fee agreement.
- Contested issues: disagreements over support, property or parenting can require negotiation, motions and hearings.
- Children: disputed parenting schedules, decision-making and support can add issues to address.
- Property: identifying assets and reviewing records can require more work when ownership or classification is disputed.
- Business valuation: financial records and valuation work may be needed when a spouse owns a business.
- Financial disclosure: in Cook County, Local Court Rules 13.3.1 (Mandatory Disclosure) and 13.3.2 (Proof of Income) apply, and the court's rules control the exchange of financial information. Incomplete records or disagreements about that information can add work.
- Hearings: the number of contested proceedings affects the preparation and attorney work required.
An uncontested divorce still requires attention to the proposed terms and court judgment. Under 750 ILCS 5/401(b), the court must consider, approve, reserve or make provision for allocation of parental responsibilities, child support, maintenance and disposition of property before entering judgment. Issues may be reserved by agreement or on motion with a court finding.
For a useful consultation, separate what you and your spouse agree on from what remains unresolved. Tell the lawyer about uncertain information as well as known disputes. That helps frame the discussion about scope without treating a preliminary conversation as a final budget.
Which divorce expenses are paid separately?
An attorney payment is not the entire divorce budget. Keep separate expenses visible when comparing representation options. This page does not estimate court filing fees or publish amounts for outside services.
Court filing costs, expert fees, service costs and evaluation costs are separate. The client pays them and the firm does not advance them. The written agreement confirms the fee, covered work and expenses before engagement. Fee ranges shown are not a quote for your matter. Call 312-965-5618 for a quote.
Review the separate-expenses note under the fee table when planning your budget and preparing questions about the written agreement.
Ask what outside work may be relevant, what purpose it serves and whether its scope can be defined before it begins. If a private mediator is used, ask how the mediator's fees are handled before mediation begins.
Can an Illinois court order a spouse to pay attorney fees?
Under 750 ILCS 5/508(a), after notice and a hearing and after considering the parties' financial resources, the court may order a party to pay a reasonable amount toward their own or the other party's costs and attorney fees. This includes interim fees in a divorce case before judgment.
Enforcement has a separate provision. Under 750 ILCS 5/508(b), when failure to comply was without compelling cause or justification, the court shall order the non-complying party to pay the prevailing party's costs and reasonable attorney fees in enforcement proceedings.
A fee contribution is not guaranteed. Whether these provisions apply depends on the facts and the court's findings.
Discuss fee contribution separately from the firm's payment agreement. A request for contribution does not itself change your obligations under that agreement. For work involving an existing order, review the separate fee structure for court order enforcement.
Ways to manage your Illinois divorce costs
Cost planning means identifying necessary work and reducing avoidable preparation. It does not mean giving up a disputed issue without understanding it. These steps may make the work more efficient, but they do not guarantee lower fees or a particular outcome.
- Organize documents. Group financial records by account or topic, and identify missing records instead of sending repeated, unlabeled copies.
- Keep a clear issue list. Separate agreed terms, disputed terms and questions that need legal review.
- Ask about limited scope. Discuss whether a defined task fits your needs and what you would remain responsible for handling.
- Discuss mediation requirements and options. Ask whether mediation is required for the issues in your case, and ask how any mediator's fees are handled.
- Evaluate settlement options. Resolving some issues may reduce the work left for contested proceedings, depending on the agreement and remaining disputes.
Under 750 ILCS 5/602.10(c), the court shall order mediation to help parents formulate, modify or implement a parenting plan unless impediments to mediation exist. In Cook County, mediation is mandatory for initial allocation of parental responsibilities, modification of allocation, relocation and non-parent visitation. The court may order mediation on other issues even if a party objects. Child-related mediation is conducted by Family Court Services if the parties cannot agree on a mediator.
In Cook County, Local Court Rules 13.3.1 (Mandatory Disclosure) and 13.3.2 (Proof of Income) apply, and the court's rules control the exchange of financial information. Gathering your income, account and property records early can reduce the time needed later. For a narrower engagement, review limited-scope family lawyer fees.
Mediation does not guarantee agreement or a lower total cost. The court must still enter the dissolution judgment. Review divorce mediation services when preparing questions about the process and the work your own lawyer would perform.

In Cook County, mediation is mandatory for initial allocation of parental responsibilities, modification of allocation, relocation and non-parent visitation.
